These Terms & Conditions apply to coaching, personal training, online programming, group training and other services provided by Brian Stokes Coaching Ltd (“BSC”, “we”, “us” or “our”).

By purchasing, booking or participating in our services, you agree to these Terms & Conditions.

1. Our Services

Brian Stokes Coaching provides fitness and performance coaching which may include:

  • HYROX and hybrid performance coaching

  • Triathlon and endurance coaching

  • One-to-one and small-group personal training

  • Online and bespoke training programmes

  • Strength and conditioning

  • NO BS Kids Crew® youth fitness sessions

  • Workshops, camps, events and other performance-related services

The exact service provided will depend on the coaching package or session purchased.

2. Coaching & Training

Training programmes are designed using the information available to us and may be adapted according to ability, goals, training history, performance, availability and feedback.

Results cannot be guaranteed. Progress depends on many factors, including consistency, effort, recovery, nutrition, lifestyle and adherence to the agreed programme.

Clients remain responsible for completing training appropriately and communicating relevant feedback to their coach.

3. Health & Fitness to Participate

You are responsible for ensuring that you are physically able to participate in training.

You must inform us of any relevant injury, illness, medical condition, medication or change in health that could affect your ability to train safely.

Where appropriate, we may recommend that you obtain clearance or advice from a suitably qualified healthcare professional before participating.

If you experience unusual pain, dizziness, chest pain, severe shortness of breath or other concerning symptoms during exercise, you should stop exercising and seek appropriate medical advice.

Our coaching services do not replace medical diagnosis, treatment or advice.

4. Bookings & Payment

Fees will be confirmed before a service begins.

Payment may be made through the payment or booking platforms made available by BSC.

For ongoing coaching, payment is normally collected monthly unless another arrangement has been agreed.

Personal training sessions and training blocks must be paid for according to the terms agreed at booking.

Failure to make payment may result in coaching, programming or access to sessions being suspended.

5. Cancellations & Missed Sessions

For individually booked personal training sessions, we ask for at least 24 hours' notice if you need to cancel or rearrange.

Sessions cancelled with less than 24 hours' notice may be charged in full or deducted from a prepaid training block.

Where BSC needs to cancel a session, we will rearrange the session or provide an appropriate credit.

Specific events, camps, group sessions or programmes may have separate cancellation terms which will be communicated when booking.

6. Online Coaching

Online coaching may be delivered using third-party platforms such as TrainingPeaks, Trainerize or other appropriate systems.

Clients are responsible for providing accurate information and feedback so that programming can be adjusted appropriately.

Training programmes are prepared for the individual client and should not be shared with or followed by another person without permission.

7. NO BS Kids Crew® & Under-18s

Participation by anyone under 18 requires the consent of a parent or legal guardian.

Parents or guardians must provide accurate information about any medical conditions, injuries, additional needs or other circumstances relevant to the child's safe participation.

Sessions are designed to be age appropriate and focus on physical literacy, movement skills, fitness, confidence, teamwork and enjoyment.

Parents and guardians remain responsible for ensuring appropriate arrangements are in place for the arrival and collection of their child.

BSC reserves the right to modify an activity or remove a participant from a session where necessary for their safety or the safety and wellbeing of others.

Safeguarding concerns will be managed in accordance with applicable safeguarding procedures.

8. Risk & Responsibility

Physical training and sport involve inherent risks, including the possibility of injury.

BSC will take reasonable steps to provide appropriately planned and supervised training. Participants are also expected to follow coaching instructions, use equipment appropriately and communicate if they are unable to perform an activity safely.

Nothing in these Terms seeks to exclude or restrict liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.

9. Training Locations

Some coaching sessions may take place at third-party gyms, facilities or venues.

Clients may also be required to comply with the rules, membership requirements and terms of the venue being used.

BSC is not responsible for services or facilities supplied independently by a third-party venue.

10. Intellectual Property

Training programmes, session plans, written materials, videos, graphics, educational resources and other original BSC materials remain the intellectual property of Brian Stokes Coaching Ltd unless otherwise stated.

They are provided for the client's personal use and must not be copied, distributed, published, sold or used commercially without prior written permission.

NO BS Kids Crew® and associated branding must not be used without permission.

11. Photographs & Media

We may occasionally take photographs or video during sessions, events or activities.

Where consent is required, particularly in relation to children and young people, appropriate permission will be obtained before identifiable material is used for promotional purposes.

You may withdraw consent for future use by contacting us.

12. Personal Information

Personal information is handled in accordance with our Privacy Policy.

Information may be processed through third-party platforms used to provide coaching, bookings, payments, communication and website services.

13. Ending Coaching

Either the client or BSC may end an ongoing coaching arrangement.

Any applicable notice period, outstanding payment or cancellation arrangement associated with a particular coaching package will continue to apply.

BSC reserves the right to end coaching immediately in cases involving abusive or threatening behaviour, serious misconduct, non-payment, safeguarding concerns or behaviour that places others at risk.

14. Changes to Services or Terms

We may occasionally change our services, prices or these Terms & Conditions.

Material changes affecting an existing paid service will be communicated where appropriate.

The latest version of these Terms will be published on our website.

15. Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer.

Where UK consumer law provides cancellation, refund or other rights that apply to a particular purchase, those rights will take precedence over any conflicting provision in these Terms.

16. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute will be subject to the applicable jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights regarding jurisdiction.
